Terms of Service: Burst Health Video Testimonial Campaign

Thank you for participating in our Burst Health Video Testimonial Campaign ("Campaign"). By submitting your video testimonial, you agree to the following Terms of Service ("Terms of Service"):

  1. Submission Agreement: By submitting your video testimonial, you grant Burst Health full rights to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your testimonial for any purpose we deem necessary, including but not limited to marketing, advertising, and promotional activities.

  1. Eligibility: The Campaign is open to all previous clients who have received services from Burst Health. Employees, affiliates, subsidiaries, advertising and promotion agencies, and immediate family members of such employees are not eligible to participate.

  1. Prize: There will be a total of 10 potential winners selected to receive a $100 gift card each. The selection of winners will be based on the quality and relevance of the testimonial, as determined by the Burst Health team. The gift card is non-transferable and may not be exchanged for cash.

  1. Submission Limit: Participants may submit multiple video testimonials. Each submission will be considered separately for the prize.

  1. Rights to Reject Submissions: Burst Health reserves the right to reject any submission that is inappropriate, offensive, or does not meet the criteria outlined for the Campaign.

  1. Notification of Winners: Winners will be notified via the contact information provided with their submission. If a winner cannot be contacted within 7 days after the selection, an alternate winner may be chosen.

  1. Publicity: By participating in the Campaign, you agree to allow Burst Health to use your name, likeness, and testimonial in promotional materials without further compensation or permission, except where prohibited by law.

  1. Disqualification: Burst Health reserves the right to disqualify any participant who violates these Terms of Service or engages in fraudulent or unfair conduct during the Campaign.

  1. Limitation of Liability: Burst Health is not responsible for any errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication line failures, theft, destruction, unauthorized access to, or alteration of entries. Burst Health is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, to the extent permitted by law.

  1. Data Protection and Privacy: Burst Health will handle and protect the personal data collected during the campaign in accordance with Australian privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

  1. Intellectual Property Rights: Participants warrant that they own the intellectual property rights to their video testimonial and indemnify Burst Health against any claims of infringement by third parties.

  1. Warranty and Liability Disclaimers: Burst Health disclaims liability for any damages, losses, or injuries arising from participation in the campaign, to the extent permitted by law.

  1. Duration and Termination: The campaign duration will be specified, and Burst Health reserves the right to terminate or suspend the campaign under certain circumstances.

  1. Force Majeure: Burst Health shall not be liable for any failure or delay in performing its obligations under the Terms of Service if such failure or delay is caused by circumstances beyond its reasonable control.

  1. Severability: If any provision of the Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

  1. Language and Interpretation: The Terms of Service shall be interpreted in accordance with the laws of Australia, and any ambiguities shall be resolved in favor of Burst Health.

  1. User Conduct: Participants are expected to conduct themselves in a manner consistent with the standards of honesty and fairness.

  1. Feedback and Complaints: Participants may submit feedback or complaints regarding the campaign process to Burst Health, and Burst Health will address such feedback in a timely manner.

  1. Independent Legal Advice: Participants are advised to seek independent legal advice before submitting their video testimonials.

By participating in the Campaign, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not submit a testimonial.
